Transgender documentarian Sam Feder's latest film "Heightened Scrutiny" offers a compelling dual perspective – simultaneously an emotional profile of a key transgender advocate and a critical examination of journalistic coverage about trans rights.
The film follows ACLU attorney Chase Strangio as he prepares for oral arguments in the landmark Supreme Court case US v Skirmetti. These proceedings happened in December 2024, with the judiciary ultimately ruling in favor of Tennessee's position, practically permitting bans on treatment for transgender young people to stay in effect across multiple US territories.
We made Heightened Scrutiny in just 16 months, stated Feder during a discussion. By contrast, my previous film Disclosure took me five years, so this was quite rushed. Our goal was to raise discussion so people would understand more about the case.
While Feder offers a thorough analysis of how major publications have spread transphobic narratives, the film's primary achievement may be its compelling depiction of Strangio. Typically a reserved lawyer in public appearances, Strangio displays his vulnerability throughout the documentary.
That was a significant challenge, to share parts of my life to a camera lens that I had strived to keep personal, stated Strangio. Feder told me he wanted future generations to know that we struggled, to see what was done in defense of these fights for our fundamental rights.
To strengthen Strangio's account, Feder incorporates multiple transgender voices, such as respected individuals from journalism and entertainment. The documentary also features viewpoints from cisgender allies who critique how respected organizations have participated to negative portrayals of trans people.
The viewpoint of transgender young people key to the legal case is represented through a extraordinary 12-year-old girl named Mila. Audiences observe her fighting for her peers at a school board meeting, with subsequent scenes showing her demonstrating for transgender rights outside the Supreme Court.
This film also contains touching moments where Feder steps outside the constant legal struggle, such as footage of Strangio vacationing in Italy and receiving a tattoo featuring verses from activist Pauli Murray's poem "Vision."
The tattoo scene is one of my favorites in the movie, stated Strangio. Being tattooed is practically like a contemplative experience for me, to be fully present in my body and to consider it as a container for things that are significant to me.
The filmmaker's attention to thoughtfully documenting Strangio getting to his body art underscores that this documentary is fundamentally about trans physical selves – not only those of youth who confront restriction of their ability to live genuinely in their own bodies, but also the bodies of the numerous subjects who appear in the film.

I hope not people to find themselves in a situation of constant discouragement because of what the law is denying us, shared Strangio. I strive to be in a practice of using the law to lessen harm, but not to turn it into some sort of pathway for our liberatory possibilities. Official institutions is not going to be the reflection through which we view ourselves.
